Shisha Original

These Terms and Conditions (the "Terms") govern the rights and obligations between PREMIUM PORCELAIN & GLASS s.r.o., as the seller, and the end customer, as the buyer, in connection with the sale of goods via the Shisha Original e-shop.

1. Basic provisions

These Terms apply exclusively to consumers (B2C) within the meaning of Section 419 of the Czech Civil Code.

2. Age restriction (18+)

Products offered on the Shisha Original e-shop are intended exclusively for persons over 18 years of age.

By placing an order, the Buyer confirms that they meet the statutory age requirement.

The Seller is entitled to verify the Buyer's age, in particular:

• before confirming the order,
• upon delivery by the carrier,
• or subsequently if there are doubts.

If the Buyer does not meet the age requirement, the Seller is entitled to cancel the order.

3. Conclusion of the purchase contract

The presentation of goods on the e-shop is for informational purposes only and does not constitute a binding offer.

By submitting an order, the Buyer makes a binding offer to enter into a purchase contract.

The purchase contract is concluded upon the Seller's confirmation of the order.

4. Prices and payment terms

Product prices displayed on the e-shop depend on the selected delivery country and the Buyer's tax status.

For Buyers with delivery within the Czech Republic and other European Union countries, prices are shown including VAT, in accordance with applicable laws.

For Buyers with delivery outside the European Union, prices may be shown excluding VAT. In such cases, the Buyer may be required to pay local taxes, customs duties, or other charges under the laws of the destination country.

The final price, including any applicable VAT, is always displayed before the order is completed in the order summary.

The price does not include shipping costs, which are shown separately.

Payment is made via the payment methods available on the e-shop.

5. Delivery of goods

Goods are delivered through contracted carriers.

Delivery times are indicative and may vary depending on availability and the nature of the goods.

6. Withdrawal from the contract

The consumer has the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.

Hygiene exception:
Pursuant to Section 1837(g) of the Czech Civil Code, it is not possible to withdraw from the contract for goods which have been removed from sealed packaging after delivery and cannot be returned for hygiene reasons.

This exception applies in particular to:

• water pipes (hookahs),
• hoses, mouthpieces, and parts that come into contact with the mouth,
• goods that have been used (filled with water, heated, smoked).

The right of withdrawal does not apply to goods made to order, personalized, or modified according to the Buyer's request (sandblasting, engraving, color modifications, etc.).

Returned goods must be undamaged, unused, and in their original packaging. The Seller is entitled to claim compensation for any reduction in value.

7. Complaints and liability

Rights arising from defective performance are governed by applicable laws.

The warranty does not cover normal wear and tear, improper use, or unauthorized/incorrect interventions.

The Buyer acknowledges that Shisha Original products are made from natural and artisan materials, in particular porcelain, hand-blown glass, and hand-applied decorative techniques (drawing/painting, sandblasting, color modifications, etc.).

Due to the nature of these materials and manufacturing processes, individual items may vary in details, especially in:

• material structure and granularity,
• minor visual irregularities,
• color shades,
• traces of hand workmanship.

These deviations are a natural characteristic of the product, confirm its handcrafted nature, and are not considered a defect within the meaning of liability for defects.

8. Personal data protection

The processing of personal data is governed by a separate document: Privacy Policy.

9. Out-of-court dispute resolution (ADR)

The entity for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce).

10. Final provisions

These Terms are governed by the laws of the Czech Republic.
